NATIONAL CITY JIU JITSU

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

1. ACKNOWLEDGMENT OF RISK

I understand and acknowledge that participation in Brazilian Jiu Jitsu, submission grappling, wrestling, Muay Thai, martial arts, self-defense training, strength and conditioning, open mat sessions, competitions, seminars, and other activities conducted by or at National City Jiu Jitsu involves inherent risks.

These risks may include, but are not limited to, falls, throws, takedowns, strikes, joint locks, chokes, submissions, contact or collision with other participants, instructors, equipment, mats, walls, or other objects, as well as sprains, strains, bruises, cuts, dislocations, fractures, concussions, and other injuries.

I understand that participation may result in serious or permanent injury, paralysis, illness, or death. I also understand that risks may result from strenuous physical activity, pre-existing medical conditions, or the actions of other participants.

I understand that even when proper techniques, supervision, safety procedures, and protective equipment are used, injuries may still occur.

2. VOLUNTARY ASSUMPTION OF RISK

I voluntarily choose to participate in activities at National City Jiu Jitsu with full knowledge of the risks involved.

I knowingly and voluntarily assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable, to the fullest extent permitted by law.

3. RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in activities, classes, training, events, competitions, seminars, open mats, or other programs conducted by or associated with National City Jiu Jitsu, I hereby release, waive, discharge, and covenant not to sue National City Jiu Jitsu, its owners, instructors, coaches, employees, independent contractors, volunteers, affiliates, landlords, property owners, event organizers, agents, representatives, successors, and assigns from claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in activities at or associated with National City Jiu Jitsu, including claims arising from ordinary negligence, to the fullest extent permitted by applicable law.

This release does not apply to conduct that cannot legally be waived under applicable law.

4. INDEMNIFICATION

I agree to indemnify and hold harmless National City Jiu Jitsu and the released parties listed above from claims, damages, liabilities, costs, or expenses, including reasonable attorney fees, arising from my participation or from my actions while participating in academy activities, to the fullest extent permitted by law.

5. MEDICAL CONDITION AND FITNESS TO PARTICIPATE

I represent that I am physically and medically capable of participating in martial arts and fitness activities.

I understand that it is my responsibility to consult with a physician or qualified medical professional regarding any medical condition, injury, medication, or limitation that could affect my ability to participate safely.

I agree to notify an instructor or coach of any relevant injury, illness, or physical limitation before participating.

6. EMERGENCY MEDICAL TREATMENT

In the event of an injury or medical emergency, I authorize National City Jiu Jitsu personnel to obtain or provide reasonable emergency medical assistance when necessary.

I understand that National City Jiu Jitsu does not guarantee the availability or quality of medical treatment.

I accept financial responsibility for medical care, ambulance transportation, hospitalization, or other expenses arising from my participation.

7. PERSONAL PROPERTY

I understand that National City Jiu Jitsu is not responsible for lost, stolen, or damaged personal property brought onto the premises or to academy-related events.

8. RULES AND CONDUCT

I agree to follow all academy rules, safety instructions, and directions given by instructors or staff.

I understand that National City Jiu Jitsu may restrict or terminate my participation if my conduct is considered unsafe, disruptive, inappropriate, or harmful to another participant.

9. COMMUNICABLE ILLNESS

I acknowledge that participation in close-contact martial arts may involve exposure to communicable illnesses, infections, skin conditions, bacteria, viruses, or other contagious conditions.

I agree not to participate when I have a known contagious condition that could reasonably place others at risk.

10. PHOTO AND VIDEO RELEASE

I authorize National City Jiu Jitsu to photograph or record me during classes, events, competitions, seminars, or other academy activities and to use such photographs or recordings for legitimate promotional, educational, social media, website, or advertising purposes.

11. MINOR PARTICIPANTS

If the participant is under 18 years of age, the parent or legal guardian signing this agreement represents that they have legal authority to consent to the minor’s participation and to enter into this agreement on the minor’s behalf.

The parent or legal guardian acknowledges the risks associated with the minor’s participation and consents to the minor participating in activities at National City Jiu Jitsu.

12. SEVERABILITY

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

13. GOVERNING LAW

This agreement shall be governed by the laws of the State of California.

14. ACKNOWLEDGMENT OF UNDERSTANDING

I acknowledge that I have carefully read this agreement and understand its contents.

I understand that by electronically signing this agreement, I am giving up certain legal rights, including certain rights to bring a claim or lawsuit against National City Jiu Jitsu and the released parties.

I acknowledge that I am entering into this agreement freely and voluntarily and intend for my electronic signature to have the same force and effect as a handwritten signature and to constitute a complete release of liability to the fullest extent permitted by law.
